How does divorce work in Singapore?
Civil divorces are heard by the Family Justice Courts under the Women’s Charter. You must usually have been married for three years, and you need to show the marriage has irretrievably broken down. Since 1 July 2024, couples who both agree can file for divorce by mutual agreement instead of proving fault.
A divorce has two stages: ending the marriage, then the ancillary matters, which are custody, care and control of children, maintenance and the division of matrimonial assets. If you and your spouse agree on everything, the case can go through the simplified uncontested track, which is quicker and cheaper.
What if my marriage was registered under Muslim law?
Muslim marriages registered under the Administration of Muslim Law Act are dissolved through the Syariah Court, using forms of divorce such as talaq, fasakh and khuluk. Emerald Law, PKWA Law and Salem Ibrahim state that they handle Syariah or Islamic law matters. Emerald Law also lists lawyers who speak Malay, Tamil and Urdu or Hindi.
